It is not a matter of legal but a matter of legitimate.

Honestly I highly doubt that server was acquired legitimately.

As I was discussing some research issues with another person on research that would cost 26+ mil HPD after going for 47 days.  He would have had to save 550K a day for 47 days roughly.  I don't have the exact numbers and don't feel like digging them up.  But that server would have taken pretty much a 500K a day income since day 1 to build give or take a week.
